Terms & Conditions.

These terms set the ground rules for using Divergents.xyz and the Divergents suite of neurodivergent-support tools.

1. Agreement to these terms

These Terms & Conditions (“Terms”) apply to Divergents.xyz and every Divergents website, application, screening experience, or service that links to them (together, the “Services”). By accessing or using a Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

A particular Service may include supplemental terms. If supplemental terms conflict with these Terms, the supplemental terms control for that Service.

2. What the Services provide

Divergents creates informational, organizational, screening, reading, reflection, prompting, and productivity tools designed with neurodivergent people in mind. Features may evolve, be experimental, or use automated and artificial-intelligence systems.

Divergents tools support understanding and action; they do not replace your judgment or the care of a qualified professional.

3. Not medical advice or a diagnosis

The Services do not provide medical advice, diagnosis, psychotherapy, crisis support, or treatment. Screening results—including ADHD pre-screening results—are not a diagnosis and should not be treated as one. Always seek a qualified professional for medical or mental-health questions and before acting on information that could affect your health.

Do not use the Services for an emergency. If you or someone else may be in immediate danger, contact local emergency services or an appropriate crisis resource.

4. Eligibility and accounts

You must be legally able to agree to these Terms. If you are under the age of majority where you live, a parent or legal guardian must review and agree to these Terms where required. Services not specifically designed for children may not be used by children under 13.

If a Service offers an account, provide accurate information, keep access credentials secure, and promptly notify us of suspected unauthorized access. You are responsible for activity performed through your account to the extent permitted by law.

5. Acceptable use

You may not:

  • Use the Services unlawfully or to harm, threaten, exploit, harass, or deceive another person.
  • Attempt to bypass security, access another person’s data, disrupt a Service, or introduce malicious code.
  • Scrape, reverse engineer, copy, or automatically extract protected parts of a Service except where the law expressly permits it.
  • Use outputs to make high-impact decisions about another person—such as employment, housing, education, insurance, credit, healthcare, or legal eligibility—without qualified human review and all required legal safeguards.
  • Misrepresent automated output as professional, clinical, or independently verified advice.

6. Your content

You retain ownership of content you submit. You give Divergents a limited, non-exclusive license to host, process, transmit, display, and otherwise use that content only as needed to provide, secure, support, and improve the Services, consistent with our Privacy Policy and the controls presented by the relevant Service.

You are responsible for having the rights needed to submit content and for avoiding unnecessary personal or confidential information.

7. Automated output

Automated or AI-generated output can be incomplete, inaccurate, or inappropriate for your circumstances. Review important output before relying on it. Divergents does not guarantee that generated suggestions, classifications, screening results, or summaries are correct or suitable for a particular purpose.

8. Divergents property

The Services—including their software, design, branding, text, graphics, and original assets—are owned by Divergents or its licensors and protected by applicable intellectual-property laws. These Terms give you a limited, revocable, non-transferable right to use the Services for their intended personal or authorized organizational purpose. They do not transfer ownership.

9. Third-party services and links

The Services may link to or work with independent products and providers. Divergents does not control and is not responsible for their content, availability, terms, or privacy practices. Your use of a third-party service is governed by its own terms.

10. Availability and changes

We may add, change, suspend, or discontinue features. We aim to provide a reliable experience but do not guarantee uninterrupted, secure, or error-free operation. We may restrict access when reasonably necessary to protect users, the Services, or others.

11. Disclaimers

To the fullest extent permitted by law, the Services are provided “as is” and “as available.” Divergents disclaims implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement. Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.

12. Limitation of liability

To the fullest extent permitted by law, Divergents and its team will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or opportunities arising from use of or inability to use the Services. Divergents’ total liability for a claim will not exceed the greater of the amount you paid for the relevant Service during the previous twelve months or US $100.

Some jurisdictions do not allow certain exclusions or limits, so part of this section may not apply to you.

13. Ending use

You may stop using the Services at any time. We may suspend or terminate access for a serious or repeated violation of these Terms, a security risk, unlawful conduct, or when a Service is discontinued. Provisions that by their nature should survive will remain effective, including ownership, disclaimers, and liability limits.

14. Applicable law and disputes

These Terms are governed by applicable law, without overriding any consumer protection that must apply where you live. Any dispute must be brought before a court or tribunal that has lawful jurisdiction over the parties and the dispute. Before filing a formal claim, you and Divergents agree to make a good-faith effort to resolve it informally.

15. Changes and contact

We may update these Terms as the Services change. We will post the revised Terms with a new effective date and provide additional notice when required. Continued use after revised Terms take effect means you accept them, except where the law requires another form of agreement.
